These Terms of Service (“Terms”) govern your access to and use of the websites, pages, forms, and services operated by Velocity Web Enterprises LLC] d/b/a Check Disability (“Check Disability,” “we,” “us,” or “our”). By accessing or using our site, you agree to these Terms and to our Privacy Policy.
No affiliation with the Social Security Administration. Check Disability is a privately owned information and referral service and is not affiliated with, endorsed by, or sponsored by the Social Security Administration (SSA) or any government agency.
No legal advice. Content on this site is for general information only and does not constitute legal advice. If you need legal advice, consult a licensed attorney in your jurisdiction.
2) Eligibility & Accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to submit information or use our referral services.
- You agree that the information you provide is accurate and complete, and you will not impersonate another person or misrepresent your eligibility.
- We may refuse, suspend, or terminate access for any reason, including suspected misuse or violation of these Terms.
3) Our Services
We provide (i) free educational content about Social Security disability benefits (SSDI/SSI); (ii) a short questionnaire that helps produce a general eligibility signal; and (iii) referrals or connections to participating disability advocates/attorneys (“Partners”).
- Eligibility signal is not a decision. Any “likely,” “possible,” or similar outcome is informational only and not a determination of eligibility, approval, or entitlement.
- Referrals. If you consent, we may share your information with one or more Partners who may contact you about a free consultation. We do not control, warrant, or guarantee any Partner’s services or outcomes.
- No fees to use the site. Initial use of our site and referrals are free to you. Partners typically charge fees as permitted by law (e.g., contingent fees paid from back pay upon approval). Any fees or terms are between you and the Partner.
4) Consent & Communications
By submitting your information, you consent to be contacted by Check Disability and our Partners by phone, text message, email, and other reasonable methods at the contact details you provide, including via autodialed or prerecorded calls or texts, consistent with your express consent and applicable law. Consent is not a condition of purchase. Message and data rates may apply.
You can opt out of marketing texts by replying STOP and can opt out of marketing emails by using the unsubscribe link. For Partner communications, please follow that Partner’s opt-out instructions directly.
We may record or monitor calls for quality and compliance. By communicating with us by phone, you consent to call recording as permitted by law.
5) Privacy & Data Practices
Your use of the site is also governed by our Privacy Policy, which explains what data we collect, how we use it, how we share it with Partners and service providers with your consent, and your choices. Please review it carefully.
- We implement reasonable security measures; however, no system is perfectly secure.
- If you submit information for a referral, we may disclose it to Partners so they can contact you about a free consultation.
6) Intellectual Property
All content, design, logos, text, graphics, and code on the site are owned by Check Disability or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
7) Acceptable Use
You agree not to:
- Use the site for any unlawful, harmful, or deceptive purpose;
- Submit false, misleading, or fraudulent information;
- Interfere with or disrupt the site, or attempt to bypass security or rate limits;
- Scrape, harvest, or collect data from the site except as permitted by law and these Terms;
- Reverse engineer or otherwise attempt to access source code except as permitted by law.
8) Third-Party Links & Partners
The site may contain links to third-party websites or resources and may facilitate connections with Partners. We do not control or endorse third-party content and are not responsible for their availability, accuracy, or practices. Your dealings with third parties are solely between you and them.
9) Disclaimers
AS IS / AS AVAILABLE. THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No guarantee of outcomes. We do not guarantee any approval, benefit amount, timeline, or result. Any eligibility signal is informational only.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Check Disability AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US, IF ANY, DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY—WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; the above may not apply to you.
11) Indemnification
You agree to defend, indemnify, and hold harmless Check Disability and our affiliates, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the site; (b) your violation of these Terms; or (c) your violation of any law or third-party rights.
12) Governing Law; Arbitration; Class-Action Waiver
Governing Law
These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles.
Binding Arbitration
Except for claims that qualify for small-claims court, you and Check Disability agree that any dispute, claim, or controversy arising out of or relating to these Terms or the site will be resolved by binding, individual arbitration administered by JAMS pursuant to its Streamlined Rules. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
Class-Action Waiver. You and Check Disability agree that each may bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to support@checkdisability.example with subject “Arbitration Opt-Out” and your full name, address, and phone number.
13) Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of the site after changes become effective means you accept the updated Terms.
14) Miscellaneous
- Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the site.
- Severability. If any provision is deemed unenforceable, the remaining provisions will remain in full force.
- No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms at any time.
